European Court Upholds Claim Based on House in Occupied Territory

The European Court of Justice has confirmed the validity of a judgment by a court of the Republic of Cyprus ordering the demolition of a house built in the occupied territory of Northern Cyprus. The owner of the land, Meletis Apostolides, was forced to flee at the time of the Turkish invasion in 1974. Two United Kingdom nationals, subsequently acquired a dubious title to the land and build a villa there. Although the Turkish Cypriot courts may still refuse to enforce the judgment, the ruling in Luxembourg will enable the owners to proceed with a claim for compensation in the courts of the United Kingdom.
