However, I'm not too sure there is the flexibility in the ICC framework to convict for "new" charges at a later stage...
I also think this decision is a good opportunity to reflect on the "special" place that Genocide has in world opinion and its ambiguous nature as an international crime.

http://dovjacobs.blogspot.com/2010/02/of-zeitgeist-and-law-bashir-decision-as.htmlDov Jacobshttps://www.blogger.com/profile/14088064995374954241noreply@blogger.comtag:blogger.com,1999:blog-4605495417463810012.post-63508360759147145252010-02-04T11:47:47.559+00:002010-02-04T11:47:47.559+00:00Perhaps we need a bit of patience with the interlo...Perhaps we need a bit of patience with the interlocutory appeals. Still early days for the Court, and isn't it worth making sure the course it takes is the right one? Remember - the house built on the sand fell down, whereas the house on the rock stood firm.

What if the parties do wait for the appeal on the merits, and the Appellate decision then rules that the judgement is flawed because of an incorrect procedural decision that might have occurred years ago - an entire trial might have been wasted, far more resources having been used than would have been the case if the issue were sorted out straight away.

In any case, it should be borne in mind that the number of interlocutory appeals should subside over time, as procedural issues become decided and greater certainty ensues.Markhttps://www.blogger.com/profile/13112722464463262830noreply@blogger.com
